Conflict of Interest
CONFLICT OF INTEREST
All Bristol Community College full-and part-time employees, volunteers, and work-study students are required to comply with the Massachusetts conflict of interest law. This law is intended to prevent conduct which causes a state employee's private interest to conflict with his/her public responsibilities. The state conflict of interest law:
- Prohibits employees from seeking or accepting gifts
- Prohibits employees from official involvement in matters in which they or those close to them have private financial interests
- Restricts employees from participation in certain kinds of outside activities (including other employment)
- Limits employees from acquiring a financial interest in public contracts except under certain circumstances specified in the law
- Prohibits employees from using their official position to secure unwarranted privileges
The law generally prohibits an employee from receiving more than one salary from the state. However, employees may receive additional compensation for extra service.
Violation of the conflict of interest law carries both civil and criminal penalties.
Faculty, Unit-Professionals & Non-Unit Professionals
Part-time teaching is acceptable provided the employee does not have official responsibility for the financial management of the institution and the hours of teaching are outside regular working hours. Other non-teaching service at Bristol Community College is permitted providing the following four conditions are met:
- The services are performed only occasionally and/or seasonal; that is, they are not permanent and they are paid on a per-diem, per hour, or on a piece basis
- The services are performed outside the normal working hours for the salaried position
- The services are not required to be performed in the course of the salaried positions. In other words, the service performed cannot be part of the regular duties of the person as described in their salaried position’s job description. If it is included in the job description, it is not extra service
- No other person is available to perform the services as part of his/her regular duties
According to the State Ethics Commission, full-time employees of Bristol Community College may accept additional non-teaching employment at another public college if the conditions above are satisfied.
A Bristol Community College employee is prohibited from taking vacation time or other paid leave to teach during regular working hours.
Classified employees may perform extra service as long as it is at times other than regular working hours for that employee. Classified employees must be compensated for extra service, by law, at one and one-half (1 ½) times for over thirty-seven and one-half (37 ½) or forty (40) hours in a week.
Conflict of Interest Law Compliance
All newly hired full-and part-time employees, volunteers, and work-study students at Bristol Community College will be provided with a Summary of the Conflict of Interest Law and an acknowledgment of receipt. A written or electronic acknowledgement of receipt of the summary must be submitted to Human Resources for retention. In compliance of the Ethics Reform Bill, the Executive Director of Human Resources will send the Summary of the Conflict of Interest Law to all employees annually. Employees are required to send an acknowledgement of receipt of the summary to Human Resources.
In additional to receiving the Summary of the Conflict of Interest Law, within 30 days of hire, all college employees (except work-study students) are required to complete online training provided by the Ethics Commission. Go to http://www.stateprog.eth.state.ma.us/ to access the training. Upon completion of the online training, employees are required to submit the “State Ethics Commission Receipt” to Human Resources for retention. The statue requires all college employees to complete the online training every two years. The training link will be provided to college employees when training renewal is required. Work-study students are not required to complete the online training.
